Terms of Service

Last updated: February 22, 2026 · Compliant with GDPR (EU) 2016/679

These Terms of Service govern access to and use of the AtGuest service. By registering for or using the service, you agree to these Terms.

1. Description of the Service

atguest is a SaaS platform for online booking that includes a booking widget, calendar, staff management, payroll calculation, analytics, and payment acceptance through integrated payment providers.

2. Account Registration

  • To use the service, you must create an account with a valid email address.
  • You are responsible for the confidentiality of your password and for any actions taken through your account.
  • If you add staff or other users to your account (administrators, specialists), you are responsible for their actions within the service in the same way as for your own.
  • You must provide accurate information about yourself and your business.

3. Plans and Payment

  • New users receive a free trial period of 2 months, with no requirement to provide card details.
  • After the trial period ends, continued use of the service requires selecting a paid plan.
  • Payment is charged according to the selected plan on a recurring basis (monthly/annually).
  • Upgrading to a higher plan takes effect immediately with a prorated charge; downgrading to a lower plan takes effect at the start of the next billing period.
  • Prices are displayed in the currency applicable to your region (euro for EU customers, US dollars for customers in the United States). The exact amount due is shown before payment confirmation.
  • All fees are exclusive of VAT and any other applicable taxes. Where required by law (including EU VAT rules for digital services), VAT will be added to your invoice based on your country and VAT-payer status.
  • We will notify you of any price changes at least 30 days in advance. Continued use of the service after a price change takes effect constitutes acceptance of the new price.

4. Right of Withdrawal (for EU Customers)

If you are a consumer residing in the European Union, the law grants you the right to withdraw from the contract within 14 days of its conclusion without giving a reason. Since atguest provides a free trial period (2 months), payment is only charged after the trial ends — by confirming payment, you agree to immediate performance of the service, which means you lose the right of withdrawal from the start of the paid period.

5. Non-Payment and Suspension of Access

If a payment cannot be charged on the due date, we will notify you and give you 7 days to update your payment details. If the outstanding balance is not settled within this time, access to the account may be temporarily suspended until payment is made. Account data is not deleted immediately in this case — the same 90-day retention period applies as for subscription cancellation.

6. Cancellation and Refunds

You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current paid period. [Specify your actual refund policy here — for example, whether refunds are provided for the unused portion of a period.]

7. Accepting Payments From Your Customers

If you use the online payment or deposit feature, these payments are processed through third-party payment providers (Stripe, LiqPay, Fondy). atguest does not store bank card data. You are responsible for complying with the requirements of these providers and applicable law regarding accepting payments from your customers.

8. API Access

On the "Network" plan and above, we grant a limited, non-exclusive, revocable license to use the atguest API to integrate with your systems. You must keep your API key confidential, must not exceed the established rate limits, and must not use the API to build a competing product. We may suspend API access without notice in case of misuse.

9. Acceptable Use

By using atguest, you agree not to:

  • Use the service for unlawful activity.
  • Attempt to gain unauthorized access to the system or to other users' data.
  • Use automated scripts, bots, or scrapers to collect data from the service.
  • Impersonate another person or provide false information about your business.
  • Post content in the system that infringes the rights of third parties, or is unlawful, offensive, or discriminatory.
  • Fail to independently obtain consent from your customers for the processing of their personal data in accordance with applicable law.
  • Share access to your account with third parties without necessity.

10. We Are Not a Party to Your Relationship With Your Customers

atguest is a tool for managing bookings, not a party to agreements between you and your customers. We are not responsible for the quality of services provided by your business, the conduct of your customers or staff, your cancellation policy, and we do not guarantee any specific business outcomes (number of bookings, revenue) from using the service.

11. Intellectual Property

All rights to the software, design, logo, and the atguest name belong to AtGuest, s.r.o. These Terms do not transfer to you any intellectual property rights in the service, other than a limited right to use it in accordance with your chosen plan.

12. Service Availability

We strive to ensure stable operation of the service, but we do not guarantee uninterrupted, error-free operation 100% of the time. Technical work or temporary outages may occur, and we will try to give advance notice of significant ones. Some new features may initially be offered in a limited beta to select users before a full release.

13. Limitation of Liability

To the extent permitted by law, atguest is not liable for indirect damages, loss of profit, or loss of data arising from the use or inability to use the service. The service is provided "as is." This limitation does not affect mandatory consumer rights that cannot be limited by contract under applicable law.

14. Indemnification

You agree to indemnify atguest against any damages, claims, or expenses (including reasonable legal fees) arising from your breach of these Terms, unlawful use of the service, or infringement of third-party rights through your content or actions.

15. Termination of Access

We may restrict or terminate access to the service in the event of a breach of these Terms, without notice in cases of serious violation (fraud, unlawful activity).

16. Assignment

You may not transfer your rights and obligations under these Terms to a third party without our written consent. We may transfer our rights and obligations under these Terms in connection with a reorganization, merger, or sale of the business.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, this does not affect the validity of the remaining provisions.

18. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and atguest regarding the use of the service and supersede all prior agreements on this subject.

19. Changes to These Terms

We may update these Terms. We will notify you of material changes by email or within the service no later than 14 days before they take effect.

20. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Slovak Republic, excluding its conflict-of-law rules.

If you are a consumer residing in the European Union, these Terms do not limit the mandatory consumer rights provided by the law of your country of residence, which apply regardless of the chosen governing law. If you reside in the EU and are not satisfied with how a dispute was resolved, you may use the European Commission's Online Dispute Resolution platform: ec.europa.eu/consumers/odr.

If you are a consumer residing in the United States, these Terms do not limit any mandatory consumer protections provided by the law of your state of residence that cannot be waived by contract.
