These Terms of Service govern access to and use of the AtGuest service. By registering for or using the service, you agree to these Terms.
atguest is a SaaS platform for online booking that includes a booking widget, calendar, staff management, payroll calculation, analytics, and payment acceptance through integrated payment providers.
If you are a consumer residing in the European Union, the law grants you the right to withdraw from the contract within 14 days of its conclusion without giving a reason. Since atguest provides a free trial period (2 months), payment is only charged after the trial ends — by confirming payment, you agree to immediate performance of the service, which means you lose the right of withdrawal from the start of the paid period.
If a payment cannot be charged on the due date, we will notify you and give you 7 days to update your payment details. If the outstanding balance is not settled within this time, access to the account may be temporarily suspended until payment is made. Account data is not deleted immediately in this case — the same 90-day retention period applies as for subscription cancellation.
You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current paid period. [Specify your actual refund policy here — for example, whether refunds are provided for the unused portion of a period.]
If you use the online payment or deposit feature, these payments are processed through third-party payment providers (Stripe, LiqPay, Fondy). atguest does not store bank card data. You are responsible for complying with the requirements of these providers and applicable law regarding accepting payments from your customers.
On the "Network" plan and above, we grant a limited, non-exclusive, revocable license to use the atguest API to integrate with your systems. You must keep your API key confidential, must not exceed the established rate limits, and must not use the API to build a competing product. We may suspend API access without notice in case of misuse.
By using atguest, you agree not to:
atguest is a tool for managing bookings, not a party to agreements between you and your customers. We are not responsible for the quality of services provided by your business, the conduct of your customers or staff, your cancellation policy, and we do not guarantee any specific business outcomes (number of bookings, revenue) from using the service.
All rights to the software, design, logo, and the atguest name belong to AtGuest, s.r.o. These Terms do not transfer to you any intellectual property rights in the service, other than a limited right to use it in accordance with your chosen plan.
We strive to ensure stable operation of the service, but we do not guarantee uninterrupted, error-free operation 100% of the time. Technical work or temporary outages may occur, and we will try to give advance notice of significant ones. Some new features may initially be offered in a limited beta to select users before a full release.
To the extent permitted by law, atguest is not liable for indirect damages, loss of profit, or loss of data arising from the use or inability to use the service. The service is provided "as is." This limitation does not affect mandatory consumer rights that cannot be limited by contract under applicable law.
You agree to indemnify atguest against any damages, claims, or expenses (including reasonable legal fees) arising from your breach of these Terms, unlawful use of the service, or infringement of third-party rights through your content or actions.
We may restrict or terminate access to the service in the event of a breach of these Terms, without notice in cases of serious violation (fraud, unlawful activity).
You may not transfer your rights and obligations under these Terms to a third party without our written consent. We may transfer our rights and obligations under these Terms in connection with a reorganization, merger, or sale of the business.
If any provision of these Terms is found to be invalid or unenforceable, this does not affect the validity of the remaining provisions.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and atguest regarding the use of the service and supersede all prior agreements on this subject.
We may update these Terms. We will notify you of material changes by email or within the service no later than 14 days before they take effect.
These Terms are governed by the laws of the Slovak Republic, excluding its conflict-of-law rules.
If you are a consumer residing in the European Union, these Terms do not limit the mandatory consumer rights provided by the law of your country of residence, which apply regardless of the chosen governing law. If you reside in the EU and are not satisfied with how a dispute was resolved, you may use the European Commission's Online Dispute Resolution platform: ec.europa.eu/consumers/odr.
If you are a consumer residing in the United States, these Terms do not limit any mandatory consumer protections provided by the law of your state of residence that cannot be waived by contract.
